CONTEXT

Best Brands Ltd and its parent company Groupe St-Hubert Ltée (collectively referred to as “Best Brands”) are major distributors of Bonne maman® brand products in Canada. As such, Best Brands is responsible for the hosting and operating in Canada of this website promoting the Bonne maman® brand products (the “Website”).

Bonne maman® brand products are manufactured by Andros (a general partnership), with a place of business in the Zone Industrielle, 46130 Biars-sur-Cère, France (“Andros”). The Bonne maman® trademark is owned by Andros and used under licence by Best Brands.

ABOUT BEST BRANDS

The ultimate parent company of Best Brands is Recipe Limited Corporation (“RECIPE”). In fact, Best Brands is now one of the restaurant and grocery banners constituting affiliates, divisions, and franchisees of RECIPE (the “RECIPE Group”). Ultimately, therefore, it is RECIPE which is responsible for the hosting and operation of this Website and for the management of Personal Information that may be collected as part of your interactions with this Website or more generally with Best Brands. More specifically, the policies and procedures relating to the management of your Personal Information are generally established and implemented by RECIPE in accordance with the terms set out in this Privacy Policy.

RECIPE recognizes the right to privacy and is firmly committed to protecting the confidentiality of Personal Information. The purpose of this Privacy Policy is to explain in detail the policies and procedures of RECIPE regarding the collection, use, and disclosure of Personal Information that you choose to share with Best Brands or other member companies of the RECIPE Group as part of your interactions with the Bonne maman® banner.

DEFINITIONS

More specifically, with respect to such interactions with this Website or any Platform, you may be asked for your name, date of birth, email address, mailing address, telephone number, credit card data, food preferences, as well as certain other Personal Information that may be necessary for the RECIPE Group to be able to conduct its business activities from time to time.

The RECIPE Group (and third parties retained by Best Brands or RECIPE) may collect the types of Personal Information described above, in particular in the following circumstances:

  • when you subscribe to mailing lists, newsletters, and email communications;
  • when you answer surveys;
  • when you participate in contests or promotions;
  • when you communicate with the RECIPE Group to ask a question, submit a comment, or make a complaint (customer service).

A significant portion of the Personal Information collected in the course of your interactions with the Bonne maman® banner in Canada is, in fact, collected by third parties whose services are used by Best Brands or RECIPE to assist in conducting certain of their business activities. In particular, but without limitation, the RECIPE Group uses third parties who offer products and services that help it to carry out the following activities: customer relationship management (CRM), e-commerce, online surveys, Wi-Fi portal, donations, and point of sales equipment.

We may also work with third parties who aggregate Personal Information or Non-Personal Information in the following ways:

  • to take advantage of certain features of Google Analytics, including but not limited to, creating reports based on impressions of the Google Display Network or providing demographic data about Internet users and their interests; and

The RECIPE Group only authorizes its service providers and business partners who collect your Personal Information to process it to carry out specific business activities on its behalf. The RECIPE Group may process your Personal Information to create a user account, communicate with you by email or otherwise, process an online or telephone order, manage your use of the Website or other Platform, respond to a communication you send, better understand you and determine how we can improve your experience with us and our products and services, including through survey results, or for any other reason that may be disclosed to you from time to time. It is possible that, at Andros’ request, we disclose your Personal Information to Andros. In this case, your Personal Information will be treated in accordance with Andros’ Privacy Policy made available on its website: www.androsna.com. The RECIPE Group does not assume any responsibility for the processing of your Personal Information by Andros.

Otherwise, we do not give, sell, rent, lease, loan, or grant your Personal Information collected to any third party outside the RECIPE Group (except to third parties working on our behalf who are required to protect the confidentiality of such Personal Information or a third party who purchases our business) unless you have authorized us to do so.

The RECIPE Group reserves the right to process Personal Information when required by the government or to comply with the requirements of applicable laws, or if the RECIPE Group deems it reasonable to do so in order to operate its Website or any Platform adequately and securely or to protect the RECIPE Group or the users of this Website or any Platform.

Your Personal Information may be stored on servers hosted in the United States or elsewhere outside of Canada, for example by a third-party service provider, and such Personal Information may be subject to disclosure in accordance with applicable laws in those jurisdictions. The RECIPE Group takes all reasonable steps to ensure that any Personal Information transferred outside of Canada is treated securely and in accordance with the data protection laws applicable in the jurisdiction where the information is processed. PROTECTION OF PERSONAL INFORMATION

The RECIPE Group has implemented and maintains reasonable administrative, physical, and technical measures to protect the Personal Information in its custody and control from unauthorized access, use, modification, and disclosure.

The RECIPE Group has implemented Personal Information retention processes to retain Personal Information only for as long as necessary to fulfill the purposes set out below or as otherwise required by law.

The RECIPE Group also takes special measures to assess the potential risks associated with the disclosure of your Personal Information. In the event of a security breach, i.e., where your Personal Information is lost, disclosed without your authorization, or becomes accessible by an unauthorized person, we will notify you of such a breach if there is a real risk of significant harm, such as, for example, personal injury, humiliation, loss of business opportunity, financial loss, or identity theft. If the breach creates a real risk of material harm, we will notify you directly as soon as possible. If we cannot notify you directly, we will notify you through a public communication. We keep a record all security breaches. Following a security breach, the RECIPE Group will investigate the cause of the breach and review the safeguards in place to prevent further breaches.

NOTE TO PARENTS

The RECIPE Group is concerned about privacy issues surrounding Personal Information and is committed to protecting the online privacy of children and ensuring safe browsing for all users of its Website. Therefore, no Personal Information should be provided to or posted on this Website by a child under the age of 18 without the permission of a parent or guardian. If a user under the age 18 wishes to send Personal Information, he or she must first provide a parent or guardian’s email address so that we can obtain permission from the parent or guardian or obtain consent from a parent or guardian on behalf of the child. No Personal Information from a child under the age of 18 will be knowingly accepted without this written permission.
